Fasano, Mediator in Art and Cultural Heritage. December 22nd, 2011.
As an answer to the specific issues in resolving disputes about art and cultural objects, i.e. about Nazi-looted art, Trophy art or Human Remains, the International Council of Museums (ICOM) and the World Intellectual Property Organization Arbitration and Mediation Center (WIPO Center) have developed a special not-for-profit mediation service. This Mediation programm is open to all kind of art disputes, also when non-members of these organizations are concerned. The aim of mediation is to reach an agreement and by this to avoid time and money consuming litigation. Within the mediation process issues of commercial, cultural, ethical, historical, moral, religious, or spiritual nature will be taken into consideration as well as customary laws. For this programm the ICOM and WIPO Center have established a specific list of mediators experienced in art and cultural heritage mediation. We’re pleased to announce that Pierfrancesco C. Fasano was listed as Mediator.

The dot brand era. June 20th, 2011.
The dot-com era is nearing its end. Soon to emerge: the world of dot-brand.
The Internet Corp. for Assigned Names and Numbers (ICANN) is overhauling domain rules later this year, ditching the “.com,” “.net,” and “.gov” organization of the Web in favor of allowing a system in which any of the Web’s 1.3 billion users–including individuals, businesses, states and organizations–will be able to create unique domains.
First off is the cost. The going rate for one of these customized domains is $185,000, not a deal-breaker for big businesses, but that’s only for the ICANN application. Then there are legal fees and the potential of cyber-squatters, the people who buy up domain names, and jack up the price when companies need to buy them later. Is it a brand new deal for domain grabbers ?

Change to Italian trademark proceedings. April 2011, 23rd.
It is likely that the Italian Patent and Trademark Office (Italian PTO) will allow opposition proceedings with respect to trademark applications made on and after 1 May 2011. To date, litigation has been the only method of contesting the validity of conflicting trademarks in Italy and the introduction of opposition proceedings will offer holders of trademarks a “cheaper and faster alternative.”
