We filed a furniture patent infringement suit (16 months trial length) and won the case before IP Section Venice Court. Legal and technical fees: 15 k €. 500 € as penalty for each future infringement. Decision will be published (even on line) on “Giornale dell’Arredamento”, leading Italian furniture magazine.

Re estate. April 15th, 2012.

Bringing a successfully mediation instance before Bar Mediation Center to enforce the preliminary sale agreement of vineyard. In Italy disputes on re estate are subject to mandatory mediation.

IP. Domains. March 14th, 2012.

Massive anti-cybersquatting UDRP aiming transfer and/or cancellation of  well-known worldwide trademark.

Guardianship. December 23rd, 2011.

After 3 years the guardianship, dealing with a re estate and archive protected by Italian Fine Arts Office and employees, filed the final and last report approved by Milan Court and closed the procedure.

Distributorship. November 11th, 2011.

P. Fasano and I. Paulovics are guiding and advising an IT Italian company on re-negotiating balanced contractual distributorship structures and schemes with a German principal.

On behalf of a well-know Italian marble Consortium, Collective Trademark owner, Fasano – Avvocati (Pierfrancesco C. Fasano and Ivett Paulovics) is bringing an anti-counterfeiting action before Milan Court IP Section against a local enterprise selling marbles distinguished by the identical geographical name.

Litigation. November 4th, 2011.

After counselling Italian client in an International arbitration in Delhi, Fasano is defending the client on reject decree issued by Milan Court of Appeal upon Indian counterpart’s petition aiming to recognize the award.

European Union. October, 2011.

Fasano called as counsel in a labour multi-trial against a bank group before Palermo Labour Court on behalf of over 70 retired bank employees raising a prejudicial request before EU Court of Justice on equal treatment principle. Fasano obtained the EU judgement C-207/2005 against the Republic of Italy.

Labour. September, 2011.

Milan Court of Appel confirmed the success ruling in a trial filed by over 1000 retired bank employees against their Pension Fund. Fasano, in pool with other labour lawyers, defends over 800 clients. Pension Fund and clients reached 70 millions Euros settlement agreement.

Tax. August 1st, 2011.

Pierfrancesco C. Fasano and Antonino Palmeri successfully advised an Italian client mentioned in so called Falciani List. The source would be the list of information that bears the name of Hervé Falciani, IT employee which removed from the office in Geneva of the HSBC bank and surrendered to French, Italian other european authorities. Apparently, the list contains almost 7000 Italian names, for a total of almost seven billion dollars, just based on two-year period 2005-2007.

ITC/Criminal Law. July, 16th, 2011.

FASANO, in pool with an advisor company, is auditing an European chemical Group (headquartered in Italy) IT areas to verify the compliance with Italian criminal law (so called 231 system from 231/01 Italian Decree).

Real Estate. June, 20th, 2011.

FASANO is advising a banking group involved in 2 re estate Funds handling with 2 main deals in Milan (City and greater area): restructuring operational company, re-thinking various boards and commission, avoiding any conflicts of interest, checking out the compliance with re estate, company and regulatory issues.

Litigation. June, 13th, 2011.

After the Italian Supreme Court (Cassazione), a bankrupt man, deprived of his passport by the Judge, sue the Republic of Italy before the European Court of Human Rights (Strasbourg – France) aiming to obtain damages for the violation of freedom of movement.

Indian Practice. June, 9th, 2011

New assignment for FASANO to sue on behalf of an Italian client, in pool with Delhi-based firm, an Indian customer before the Delhi High Court.

Tax. June 6th, 2011

Still going on the successful debt recovery against Italian local tax office ruled by EU Court of Justice judgement (C-207/2005, Vergani vs Agenzia Entrate Arona) upon FASANO request.

Criminal Law. White Collar Crime. June 1st, 2011.

FASANO is checking out, by an opinion to Board of the Directors, the compliance of a banking group system with Italian Decree no. 231/01 to avoid white collar crimes.

Indian Practice. May 31st, 2011

In cooperation with Delhi-based advocates, the High Court cancels, upon FASANO’S request, a preemptive civil action on international trade matter taken by Indian importer against an Italian client.

International Trade. May 31st, 2011

Assigned by an Italian client, FASANO is negotiating, even through its local partner’s support, with Indian buyer a deal on Italian marble “freezed” by Indian Custom & Duties Authority in Nhava Sheva Port (Mumbai).

Litigation. May 30th, 2011

On behalf of an Italian client FASANO is bringing an EU cross border civil action to recover a debt against an Austrian client.

Labour. May 29th, 2011

After success before Milan Court, FASANO, in pool with other labour lawyers, is defending over 800 retired bank employees against a major Pension Fund before Milan Court of Appeal. The judgement is expected within this summer.

IP. Patent. May 15th, 2011

A description and seize case, initiated by FASANO, is pending before the Venice Court to protect a patent on furniture sector components.

Renewable Energy. May 8th, 2011

FASANO advised a family owned business on photovoltaic energy in Province of Pavia (Lombardy Region). We assisted land owners on negotiation with developer to closing through the local permission to authorize solar park build up.

Finance & Banking. March, 2011

FASANO is advising an Italian banking group to re-launch its stocks broking company, comply with Italian regulatory system and deal with Italian Stocks Exchange Commission (CONSOB).
